Abstract:
We are all living in the Cyber Age today and we cannot isolate ourselves against the omnipresent and omnipotent cyber invasion, which touches each one of us, in some way or the other, sparing no one. Cyber Crimes being transnational in nature, have created jurisdictional conflicts and replaced the basic principles of criminal laws in respect of place of offence, due to the capability of commission of these crimes in the comforts of one’s home.
Against this backdrop, in this paper the author has discussed evolution of Cyber Consumerism along with benefits and threats due to darker side of cyber use as well as right of cyber consumers. The author also focused on illusion of cyber privacy and anonymity and need of equilibrium between security and privacy. The scope of paper revolves around hazards of Cyber Crimes, its classification and challenges faced by investigating agencies.
The human right jurisprudence in context of Cyber rights has been discussed in a nutshell in context of relevant international treaties and covenants. The international and national Cyber Crime scenario and forms of Cyber Crimes requiring a legal framework for its control has been enumerated. It also includes legislative enactments and subsequent amendments in the context of Information Technology Act, 2000 in India. The paper is concluded with some practical suggestions.
